Apple considered that Amazon is improperly using its trademarked "App Store" denomination for the "Amazon Appstore" and has filed suit asking the court to force Amazon into no longer using the name, preventing confusion and damage.
U.S. District Judge Phyllis Hamilton said that she will "probably" deny the motion back at the end of June and things just happened to turn out exactly that way. Because Apple has not established "a likelihood of confusion" with Amazon's own Appstore (one word) to get an injunction, the court has denied Cupertino's request of stopping Amazon from using the name.
The trial date has been set for October 2012 and, with the recent ruling in favor of Amazon, Apple will likely have to cope with its own App Store against Amazon's Appstore for at least 16 months, except if its legal team comes up with some new hocus pocus along the way.
